Jason West and Vince Zampella alleging publisher trumped up HR charges, conducted “Orwellian” investigation in order to avoid paying royalties, giving them control over Modern Warfare franchise.

The basics of Jason West and Vince Zampella’s lawsuit against their former employer Activision were laid out in a press release from their legal representation this morning, but the announcement lacked some colorful details from the actual court filing. The developers’ attorneys have provided GameSpot with a copy of the suit, which paints a more fleshed out picture of Activision’s alleged misdeeds.

“This lawsuit is solely and regrettably the result of the astonishing arrogance and unbridled greed of defendant Activision,” the suit begins, before getting to the accusations at the heart of the dispute. The developers are accusing Activision of launching a bogus investigation into the pair’s activities specifically for the purpose of firing them and evading contractual obligations, as well as royalty payments set to begin March 31.

In detailing the investigation that led to their exit from the company, West and Zampella claim that Activision refused to tell them what they were being investigated for, “insisting instead in Orwellian fashion that West and Zampella ‘already have a clear understanding of what they have or have not done.’” The publisher’s investigators are accused of using strongarm tactics, including a six-hour “interrogation” in a windowless conference room over the President’s Day weekend.

Additionally, West and Zampella said Activision representatives interviewed other Infinity Ward employees so doggedly it drove them to tears, and then told the pair they would be guilty of insubordination–grounds for termination–if they attempted to console the employees. The suit also claims that Activision insisted that West and Zampella turn over their personal computers, cell phones, and other such devices for review. When the pair cited their right to privacy, they were told that asserting that right would be considered insubordination.

Beyond the investigation and the way it was conducted, West and Zampella are also accusing Activision of trying to back out of a 2008 agreement with the developers. Under the terms of that deal, West and Zampella would extend their contracts until October of 2011 and deliver the finished version of Modern Warfare 2 by November 15, 2009.

In return, the publisher promised to give the pair creative control over any Call of Duty game set after the Vietnam era (including near-future and far-future versions) or using the Modern Warfare brand. West and Zampella also claim the agreement gave them the right to run Infinity Ward independently of Activision (while remaining a wholly owned subsidiary of the publisher), to develop a new intellectual property after finishing Modern Warfare 2, as well as increased compensation in the form of stock options and royalties for all Call of Duty games, as well as non-Call of Duty games that are built using Infinity Ward’s Modern Warfare engine.

“Activision has adopted the corporate strategy of forcing Messrs. West and Zampella to sue for their pay–in the hopes of either getting away with not having to pay them anything, or maximizing its leverage to reduce that pay,” the suit alleges. “Such actions are not surprising, given that Activision is run by a CEO who has been publicly quoted as believing the best way to run a videogame studio is to engender a culture of ’skepticism, pessimism, and fear,’ and who prefers to pay his lawyers instead of his employees.”

West and Zampella are demanding $36 million in damages (as of the date of the filing), future royalties, legal fees, and a judicial determination of their rights to creative control of the Modern Warfare brand, as well as their rights over the Call of Duty brand, as stated in the 2008 agreement.

Caesar 3 added to GoG, Interstate ‘76 on Thursday

DRM-free download site GoG is offering up two classics this week: Sierra’s city-building sim, Caesar 3, and Activision’s classic car combat game, Interstate ‘76 — both for $5.99. You’ll find that the former is already available to download, but you’ll have to wait until Thursday to get behind the wheel of I76 and play Sly Stallone make believe. Watch out for traffic — it’s murder.

Ex-Yahoo exec Dan Rosensweig departs “to pursue other career opportunities” after less than a year on the job.

Last March, Activision made a splash by hiring former Yahoo COO Dan Rosensweig to serve as president and CEO of Guitar Hero developer RedOctane. Today the publisher announced that Rosensweig’s term of service with the company has ended, with the executive moving on “to pursue other career opportunities.”

Rosensweig took the helm of the Guitar Hero business as the music genre was beginning a precipitous decline. Despite a flood of releases, including Guitar Hero 5, Guitar Hero: Metallica, Guitar Hero: Van Halen, DJ Hero, Guitar Hero: Smash Hits, Guitar Hero On Tour: Modern Hits, Band Hero, Rock Band: The Beatles, and Lego Rock Band, rhythm game sales were barely half what they were the year before. According to Wedbush analyst Michael Pachter, US retail revenues from rhythm games totaled $876 million in 2009, down more than 47 percent from $1.66 billion the year before.

The executive’s stint with Activision may be best remembered for a September interview in which he claimed Guitar Hero 5 was outselling rival The Beatles: Rock Band 4-to-1 in the US. The following month when the industry-tracking NPD Group released its figures, The Beatles: Rock Band was the best-selling rhythm game with 595,000 copies sold, compared to Guitar Hero 5’s sales of 499,000.

Rosensweig’s role at Activision will be filled by David Haddad, currently the COO of the Guitar Hero business unit. Before joining Activision, Haddad served as COO of Vivendi Games’ Sierra Online division.

As for what other opportunities Rosensweig is pursuing, the executive is the new president and CEO of Chegg.com, an online textbook rental company. Looking to capitalize on frugal students who don’t want to shell out for expensive course materials, the service lets users rent books by the semester or the quarter.

Wii | New Super Mario Bros. Wii sales near 10.5 million

Modern-day redux of classic platformer sells over 3 million units in Japan, nearly 3 million in EU, and more than 4.5 million in North America.

There was no question that New Super Mario Bros. Wii was going to be popular. Its fan base was pre-built, with millions having played its forbearer, Super Mario Bros., in the 1980s. Besides helping launch the NES platform, the original title also spawned a series of sequels. The most recent spin-off, New Super Mario Bros. for the DS, has remained so popular since its 2006 launch that it made
NPD’s monthly US top 10 bestseller list several times in 2009.

Now, Japanese news service Nikkei (subscription required) is reporting figures from industry-research group Enterbrain which show exactly how popular New Super Mario Bros. Wii is. The four-person-multiplayer, 3D-side-scroller has sold nearly 10.5 million units in just over two months. In North America, over 4.5 million units have been picked up since it launched November 15. In Europe, where the game debuted November 20, sales are nearing 3 million. In Japan, over 3 million units have been purchased since the platformer’s arrival in stores December 3.

Besides reporting sales figures, Nikkei made the claim that New Super Mario Bros. Wii is “the fastest title in history to attain [the 10 million unit] mark.” However, the claim seems inaccurate when compared to sales figures of Call of Duty: Modern Warfare 2. The console editions of Activision’s multiplatform military shooter, which went on sale November 10 worldwide, sold 8.82 million units in the US alone in just over a month and a half. It has since gone on to gross over $1 billion.

Publisher counts Guitar Hero franchise extension as original intellectual property, says $120 rhythm game grossed more in US and Europe than any other new brand.

Last year saw a number of attention-grabbing original intellectual properties, including Dragon Age: Origins, Brutal Legend, Infamous, Prototype, EA Sports Active, and GameSpot’s 2009 Game of the Year, Demon’s Souls. However, Activision claims that its recently released DJ Hero topped them all.

The publisher today declared DJ Hero the “highest grossing new IP in the US and Europe for calendar 2009,” citing the industry-tracking NPD Group as the source of its information. One factor in the game’s favor was a $120 price tag, meaning DJ Hero could match a standard $60 title’s gross take by selling half as many copies.

Activision did not provide a dollar amount for the game or sales figures for the game. However, as previously reported, DJ Hero sold 298,000 copies on all platforms combined in its first two months on the US market, according to the NPD Group.

Perhaps paradoxically, Activision touts the game as an original intellectual property but also considers it part of the Guitar Hero franchise. In announcing DJ Hero’s “highest grossing” designation, Activision Blizzard CEO Robert Kotick said the game “further establishes Guitar Hero as the premier franchise of its kind.”

Regardless of sales figures relative to other games, DJ Hero has performed well enough for Activision to commit to another installment. In the most recent issue of Game Informer, Kotick confirmed that a second version of the game is in the works, saying, “I can’t wait for you to see next year’s.”

Xbox 360 | Lips sings Party Classics March 2

Microsoft’s Xbox 360-exclusive karaoke rhythm game brings 40 new on-dics tracks from Spice Girls, KISS, Village People, more; January DLC detailed.

Microsoft’s big push into the casual market will come later this year with the launch of its camera-based motion-sensing add-on currently known as Project Natal. However, that isn’t the only motion-sensing product the publisher has aimed at the casual market. Today, Microsoft announced that its motion-sensing mic-equipped karaoke franchise Lips will expand in North America on March 2 with the launch of Party Classics. The game will land in Europe beginning February 26.

As with previous installments in the franchise, Party Classics integrates with a wireless, motion-sensing microphone that syncs up with the various songs in the game to create unique light displays. Notably, Party Classics introduces the ability to use third-party USB microphones, such as those that come with Activision’s and Electronic Arts’ respective Guitar Hero and Rock Band franchises.

Party Classics features 40 on-disc songs. Artists slated to appear in the game include the Spice Girls, KISS, Village People, Tiffany, Gloria Gaynor, The B-52s, and Chumbawumba. The game also supports Avatars and Avatar rewards, as well as the customary set of achievements and other features.

Microsoft also today announced the lineup of Lips’ weekly downloadable content for January. Included in the lineup are tunes from Death Cab for Cutie, The Miracles, Fleetwood Mac, The Cardigans, and more. Tracks run for MSP 160 ($2) a piece, with The Miracles and The Cardigans song packs available for MSP 440 ($5.50) a piece. January’s full lineup of DLC can be found below.

Robomodo CEO hints at new software for RIDE peripheral

Robomodo CEO David Michicich hinted that more software for the Tony Hawk: RIDE skateboard controller could be on its way. When asked if the developer had other ideas for the peripheral’s use outside of the skating genre in an interview with Develop, Michicich replied, “We’re doing a game with Activision and we’re not allowed to talk about it right now.”

In June 2009, Robomodo president Joshua Tsui commented that the (probably going to be involved in its fair share of accidental injury lawsuits) peripheral could be used for a variety of software. “The obvious ones are snowboarding and surfing and such,” he told Videogamer.

With a new entry into the Tony Hawk: RIDE franchise probably already in the planning stages, it appears the hardware will see new software to help lighten consumer guilt. Sure, our dream is for some kind of Lumberjack Simulator to be in development, but the controller will more than likely focus on something closer to snowboarding. If EA hasn’t jumped on that train yet, former EA employees are more than welcome to try.

Select GameStops in NY, OH and PA selling Modern Warfare 2 already

Poor, poor GameStop. As the gaming public’s anticipation for Call of Duty: Modern Warfare 2 approached critical mass, they faltered in their loyalty, and took their business to small “mom and pop” game retailers who had broken the game’s street date. Fortunately for the retail juggernaut, Activision showed compassion for its plight, and agreed to let certain GameStops in a few Northeast states start selling the game before Tuesday in order to help combat these vicious local businesses.

We’ve been receiving tips all morning from folks living in New York and Pennsylvania (and Kotaku reports Ohio as well) stating that they were able to find the game on sale at their local GameStop. If you live in one of those Northeastern states, you might want to go ahead and call your local ‘Stop to see if it’s one of the stores which was granted special permission. If it is, then you can go straight to hell, you lucky jerk.
